1. Introduction

The Privacy Policy explains how we collect, safeguard and disclose information that results from your use of our Website. By using the Website, you agree to the collection and use of information in accordance with the Privacy Policy. Unless otherwise defined in the Privacy Policy, the terms used in the Privacy Policy have the same meanings as in the Terms and Conditions. The Terms and Conditions governs your use of our Website and together with the Privacy Policy constitute your agreement with us (“Agreement”).

 

2. Definitions

The terms used in the Privacy Policy shall mean respectively:

Privacy Policy — this Privacy Policy.
NewEduTrend: Find Your Educator or Website — the website available at search.newedutrend.com, providing services to Users under the rules set out in the Terms and Conditions and in accordance with the applicable laws.
NET24 or Company (hereinafter also referred to as “we”, “us” or “our”) — the entity that owns and operates the Website, i.e. NET24 Sp. z o.o., a company based in Warsaw, Poland (10A Skierniewicka street), entered into the Register of Entrepreneurs kept by the District Court in Warsaw, 12th Commercial Division of the National Court Register, under no. KRS 0000903530, and into the National Official Business Register under no. REGON 389079320.
User (hereinafter also referred to as “you” or “your”) — the individual using the Website and the company or organization on behalf of which that individual is using the Website. If you use the Website on behalf of a company or organization, “User”, “you” or “your” shall include that company or organization and any individuals associated therewith using the Website, and you are agreeing to the above Agreement on behalf of your company or organization and representing that you are authorized to do so. You are nevertheless individually bound by this Agreement even if your company or organization has a separate agreement with NET24.
Personal Data — any information relating to a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that person.
Data Subject — the identified or identifiable living individual to whom Personal Data relates.
Data Controller or Controller — a natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Data. For the purpose of this Privacy Policy, we are a Data Controller of your data.
Data Processor or Processor — a natural or legal person, public authority, agency or other body which processes Personal Data on behalf of the Controller. We may use the services of various service providers (Processors) in order to process your data more effectively.

3.1. Personal Data

3.1.1. We may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

The sensitive personal data may be transferred only if the User provides the details in the relevant form and consents to the data being forwarded to entities registered on the Website, such as educational institutions and student recruitment agencies.

NET24 uses the collected data for various purposes:

4.1. To provide and maintain our Website.
4.2. To notify you about changes to our Website.
4.3. To allow you to participate in interactive features of our Website when you choose to do so.

5. Retention of Data

5.1. We will retain your Personal Data only for as long as it is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

5.2. We will also retain the Usage Data for internal analysis purposes. The Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Website, or we are legally obligated to retain this data for longer time periods.

6.2. If you are located outside Poland and choose to provide information to us, please note that we transfer the data, including Personal Data, to Poland and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

NET24 will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

 

7. Disclosure of Data

We may disclose personal information that we collect, or you provide:

7.1. Disclosure for law enforcement. Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.
7.2. Business transaction. If we or our subsidiaries are involved in a merger, acquisition or asset sale, your Personal Data may be transferred.

In accordance with the General Data Protection Regulation (GDPR), Users and Educators can request, edit, rectify, and erase their personal data. After submission, requests for data access, rectification, or deletion can be made by contacting our support team.

9.5. In certain circumstances, you have the following data protection rights:

9.5.1. The right to access, update or to delete the information we have on you.
9.5.2. The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
9.5.3. The right to object. You have the right to object to our processing of your Personal Data.
9.5.4. The right of restriction. You have the right to request that we restrict the processing of your personal information.
9.5.5. The right to data portability. You have the right to be provided with a copy of your Personal Data in a structured, machine-readable and commonly used format.
9.5.6. The right to withdraw consent. You also have the right to withdraw your consent at any time where we rely on your consent to process your personal information.

9.6. We may ask you to verify your identity before responding to such requests. Please note that we may not able to provide the Website services without some necessary data.

10. Your Data Protection Rights under the California Online Privacy Protection Act (CalOPPA)

10.1. CalOPPA is the first state law in the United States requiring commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require a person or company in the United States (and conceivable the world) that operates websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy.

10.2. According to CalOPPA, we agree to the following:

10.2.1. Users can visit our Website anonymously.
10.2.2. Our Privacy Policy link includes the word “Privacy”, and can easily be found on the homepage of our Website.
10.2.3. Users will be notified of any Privacy Policy changes on our Privacy Policy page.
10.2.4. Users are able to change their personal information by emailing us at office@newedutrend.com.

10.3. We honor Do Not Track signals and do not track, plant cookies, or use advertising when a Do Not Track browser mechanism is in place. Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings section of your web browser.

11.1.2. The categories of sources from which we collect your personal information.
11.1.3. The business or commercial purpose for collecting or selling your personal information.
11.1.4. The categories of third parties with whom we share personal information.
11.1.5. The specific pieces of personal information we have collected about you.
11.1.6. A list of categories of personal information that we have sold, along with the category of any other company we sold it to. If we have not sold your personal information, we will inform you of that fact.
11.1.7. A list of categories of personal information that we have disclosed for a business purpose, along with the category of any other company we shared it with.

Please note that you are entitled to ask us to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to the personal information we collected about you in the previous 12 (twelve) months.

11.2. To delete your personal information. If you make this request, we will delete the personal information we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your personal information, you may not be able to use certain functions that require your personal information to operate.

11.3. To stop selling your personal information. We don’t sell or rent your personal information to any third parties for any purpose. We do not sell your personal information for monetary consideration. However, under some circumstances, a transfer of personal information to a third party, or within our family of companies, without monetary consideration may be considered a “sale” under California law. You are the only owner of your Personal Data and can request disclosure or deletion at any time.

If you submit a request to stop selling your personal information, we will stop making such transfers. Please note that if you ask us to delete or stop selling your data, it may impact your experience with us, and you may not be able to participate in certain programs or membership services which require the usage of your personal information to function. But in no circumstances, we will discriminate against you for exercising your rights.

You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party websites or services. We strongly advise you to read the terms of service and privacy policies of any third-party websites or services that you visit.

 

17. Children’s Privacy

Our Website services are not intended for use by children under the age of 18 (“Child” or “Children”). We do not knowingly collect personally identifiable information from Children under 18. If you become aware that a Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from Children without verification of parental consent, we take steps to remove that information from our servers.

 

18. Changes to the Privacy Policy
